Haul road construction began at the mine site shortly before the first Division inspection, which <br />occurred on 18 August 1995. In mid-August 1996, the operator began stripping topsoil at the <br />first pit. The dragline was moved in late October through eazly November of 1996 and actual <br />mining operations commenced shortly thereafter. <br />The Division on January 28, 2000 received an application for permit renewal. The Division on <br />Mazch 6, 2001 wrote a proposed Decision and Findings of Compliance for Permit Renewal No. <br />1. The permit renewal was approved on May 1, 2001, for another five-yeaz-term. <br />Since the permit renewal proposed decision date of Mazch 6, 2001, two Notices of Violation <br />were issued. NOV C-2001-009 and NOV C-2001-013 were both written for "Failure to comply <br />with the maximum weight of explosives to be detonated as determined by the scaled-distance <br />equation and failure to obtain Division approval for the use of a modified equation to determine <br />maximum weight of explosives per delay". NOV C-2001-009 was issued on September 6, 2001 <br />and NOV C-2001-013 was issued on October 26, 2001. To abate these NOVs, SCC <br />implemented a program to ensure compliance with the scaled-distance equation for blasting, <br />unless use of a modified equation is approved by the Division in advance of blasting. Both <br />NOV's were terminated. <br />SECTION II -REVISIONS TO THE PERNIIT <br />The following is a summary of the revisions to the permit since the Permit Renewal No. 1 <br />Findings Document dated March 6, 2001. Since the last permit renewal there has been an <br />increase in bond amount required from $4,308,467.00 to $4,418,844.00 as a result of revisions to <br />the permit (MR18 & TR21). <br />Anew reclamation cost estimate has been prepared for the 2003 Midterm Review for the Yoast <br />Mine. As stated in Section VI, the revised cost estimate represents an increase of $36,473.00 <br />over SCC's current liability of $4,418,844.00. The revised cost estimate is attached.
