violations are appealed, the permittee shall submit to the Division <br /> verification of the resolution of the appeals as soon as possible. <br /> In an October 24 , 1994 letter, PCC submitted information verifying <br /> that the audit violation was under appeal , the CMIS violation had <br /> been terminated, and that a consent order had been issued July 28, <br /> 1994 for the Kentucky State Violation, and that work was <br /> proceeding. <br /> Documentation regarding final resolution of the audit violation and <br /> the Kentucky State Violation is not on file. <br /> Stipulation No. 14 was attached to Technical Revision No. 21 , <br /> issued March 6, 1995, and required submittal of an air emission <br /> permit prior to construction of the North Portal coal handling <br /> facilities described in the revision. <br /> A copy of the initially approved air emission permit for the <br /> facility was observed in the mine office on July 5, 1995, but a <br /> copy has not yet been provided to the Division. Upon submittal to <br /> the Division, the stipulation will be resolved. <br /> Revisions <br /> Five technical revisions (TR's) and 10 minor revisions (MR's) have <br /> been approved since the Division's proposed renewal decision was <br /> issued June 8 , 1993 . One technical revision (TR 20) is currently <br /> under review. The various revisions are briefly described below: <br /> TR 16 proposed approval decision was issued January 4, 1994 . The <br /> revision allows for a reduced cover depth on approved coal <br /> processing waste disposal piles, including the Roadside refuse <br /> pile, CRDA No. 1 , CRDA No. 2 , and CRDA No. 3 . The approval was <br /> based on evaluation of data from cover depth field trials conducted <br /> on the Roadside refuse pile over a 10 year period. <br /> Important aspects of the revision include the following: <br /> 1) A minimum of 18" of non-toxic cover will be placed on the <br /> Roadside Refuse Pile, and Cameo Refuse Disposal Areas No. 1 and No <br /> 3 . A minimum of 24" of non-toxic cover will be placed on Cameo <br /> Refuse Disposal Area No. 2. <br /> 2 ) During operations on the Cameo disposal areas, <br /> contemporaneous reclamation will be completed on a given bench and <br /> outslope below the bench within 1 year of completion of refuse <br /> placement and grading of the second bench above the previously <br /> covered and seeded area, unless the bench to be covered is still <br /> actively dewatering through seeps. In this instance, covering and <br /> seeding of the bench may be delayed one additional year. In other <br /> words, a minimum of 1 completed bench would always be maintained <br /> between the active disposal bench and the most recently covered and <br />
