The letter further indicated that a hearing on the referenced State <br /> of Kentucky violation was scheduled for November 1 , 1993 , and that <br /> the results of the hearing would be forwarded to the Division upon <br /> issuance of a decision. <br /> Documentation of final resolution is not on file. <br /> Stipulation No. 12 specified completion of a surface visual <br /> inspection within areas to be undermined during the five year <br /> permit term, to document and photograph any surface structures or <br /> features to be undermined. The stipulation also specified semi- <br /> annual inspection of undermined areas to identify, record, measure <br /> and map subsidence cracks or other effects, with results to be <br /> submitted in an annual subsidence report. <br /> In accordance with the stipulation, subsidence reports were <br /> received for both 1993 and 1994 . The 1993 report included <br /> photographs and narrative documentation based on a single inspecton <br /> conducted by the operator on September 22 and September 24 , 1993 , <br /> within portions of the permit area projected to be undermined <br /> during the permit term. The inspection covered areas to the south <br /> of the 2 West Portals. on the west end of the projected mining area, <br /> and to the south and west if Cottonwood Creek in the northeast <br /> portion of the projected mining area. At the time the inspection <br /> was conducted, mining was not anticipated within the Roadside North <br /> Portals during the permit term, and so no inspection was conducted <br /> on land overlying the projected north portal workings. The report <br /> indicated that no buildings, structures , or known cultural <br /> resources were located within the area projected to be undermined. <br /> The 1994 report included photos and narrative documentation of one <br /> spot inspection and two regular inspections conducted in January, <br /> May, and September, 1994 , respectively. The inspections covered <br /> recently undermined areas within the Roadside South Portal portion <br /> of the permit area. Two separate surface cracks were observed and <br /> documented in sites overlying areas of secondary extraction, <br /> possibly the result of subsidence. The cracks were in undeveloped <br /> upland areas. The report noted that development mining resumed in <br /> the Roadside North Portal in November, 1994, and the cover letter <br /> to the report stated that the 1995 subsidence survey would include <br /> inspections of the Roadside North mining area projected to be <br /> undermined during the permit term. <br /> This stipulation is still active. <br /> Stipulation No. 13 was attached to Minor Revision No. 23 <br /> Identification of Interest modifications associated with the <br /> replacement of certain officers in companies affiliated with <br /> Powderhorn Coal Company. The approval with conditions decision was . <br /> issued August 29 , 1994 . The stipulation required the operator to <br /> submit, within 60 days, verification that Audit Violation <br /> 930242003 : 940315, CMIS Violation C94-020-370-1 : 5420.00 and Kentucky <br /> State Violation 010677:8850005: 1 :KY have been or are being <br /> corrected, or that the violations are under appeal .
