Mid-Term Review <br /> Roadside Portals , Permit No. C-81-041 <br /> This document presents the results of the Division's mid-term <br /> review for the Roadside Portals. This review was conducted to <br /> fulfill the requirements of Rules 2.08. 3 , 2 . 06. 2(9) , 2.06 . 3(4) , <br /> 2.06. 5( 3) , 2 . 06.7(5) and 3 . 02. 2(4) . <br /> Rule 2 . 08. 3 requires that the Division conduct a review of each <br /> permit issued prior to its mid-term. Based on this review, for <br /> good cause shown, the Division may require reasonable revision or <br /> modification of the permit provisions to ensure compliance with the <br /> Act and Regulations. <br /> Rules 2 . 06 . 2 , 2.06. 3 , 2.06 . 5 and 2. 06 . 7 require that experimental <br /> practices, mountaintop removal variances, steep slope variances <br /> from AOC, and variances from contemporaneous reclamation for <br /> combined surface and underground mining be reviewed by the Division <br /> where applicable. None of these categories apply to the Roadside <br /> Portals. <br /> The applicant had in the original permit application requested a <br /> variance for delay in contemporaneous reclamation for the Roadside <br /> coal processing waste bank, to allow for the development of an <br /> experimental practice regarding reclamation of the then existing <br /> Roadside and proposed future Cameo waste piles with less than 4 <br /> feet of cover. An experimental practice was never undertaken, <br /> rather field trials were established and evaluated over a 10 year <br /> period. Upon completion of the field trials, Technical Revision <br /> No. 16, which specifies required refuse cover depths for the <br /> Roadside waste bank and Cameo Refuse Disposal Areas 1, 2 and 3 , was <br /> submitted and approved. Upon approval of TR 16, exposed refuse <br /> benches at CRDA #1 and #2 were covered with the appropriate amount <br /> of non-toxic cover, and seeded with the final seedmix. The slopes <br /> of the Roadside waste bank were covered with 6" of soil and seeded <br /> with a stabilizing seedmix when the field trials were initiated. <br /> Final non-toxic cover application and permanent seeding of the <br /> Roadside Waste Bank has not yet been initiated. <br /> Rule 3 . 02 . 2(4) requires that the Division review the amount of the <br /> bond and the terms of acceptance of the bond every 2 1/2 years. <br /> This is covered in Section IV of this document. <br /> The review consisted of a review of all previous findings documents <br /> associated with the mine, annual reclamation reports, annual <br /> hydrology reports, revisions, stipulations, and inspection reports <br /> issued since the most recent permit renewal . <br /> The document is organized as follows: Section I includes a brief <br /> history of the mine. Section II summarizes any revisions to the <br /> permit since the last renewal and lists any stipulations and <br />
