• Stipulation 11: As soon as possible, have the directors of <br />National King Coal, LLC, submit information that indicate <br />[sic] Applicant Violator System (AVS) problems associated <br />with coal mine Pemit no's.(sic] 5009089 and 5004381 in West <br />Virginia have been resolved. <br />Stipulation 12: Within 90 days, submit a new Regional <br />Hydrology Map which includes surface water monitoring <br />stations, MSL depths of water elevations for each of the <br />wells within one mile of the permit boundary (if available), <br />and elevation contours of the Point Lookout Sandstone <br />aquifer. <br />Stipulation 13: Within 90 days, submit a technical revision <br />to update the permit boundary and include areas which are <br />affected by the angle of draw principle. <br />OSM has attached no special conditions to these mining plan <br />actions. <br />D. Statement of Environmental Significance of the Proposed <br />Action <br />• The undersigned person has determined that the proposed action <br />would not have a significant impact on the quality of the human <br />environment under section 102(2)(C) of the National Environmental <br />Policy Act of 1969 (NEPA), 42 U.S.C. §§ 4332(2)(C), and <br />therefore, an environmental impact statement is not required. <br />This finding of no significant impact is based on the following <br />environmental documents prepared by BLM and OSM for the leasing <br />of Federal leases C-29125 and COC-99965: <br />- OSM and BLM, August 1996.
