GENERAL STATEMENT The United of America, represented by the Director or his authorized representative, Office of Surface Mining Reclamation and Enforcement (OSM), United States Department of the Interior (DOI), and the Colorado Mined Land Reclamation Division (hereafter referred to as the Recipient), mutually agree to perform this agreement in accordance with the Departmer.= of Interior Appropriations Act, the Surface Mining Control and Reclamatic- Act of 1977 (SMCRA), Public Law 95-87(hereafter referred to as the Act), with the regulations by OSM as set forth in 30 CFR Chapter VII, policie=_, guidelines, and requirements including OMB Circulares No. A-128, A-87, Grants Management Common Rule codified at 43 CFR 12 and Treasure Circular 1975 codified at 31 CFR 205, and with the terms promised, estimated, procedures, cooperative agreement proposal, and assurances submitted and hereby made a part hereof as related to the acceptance and use of Federal funds for this Cooperative Agreement. In consideration of the promises made by the Recipient, The United State= hereby promises to obligate to the Recipient the amount of money set for=: above as the Federal Funding Amount. In consideration of the promises made by the United States herein, the Recipient hereby promises to execu~_ the Cooperative Agreement terms and conditions described in accordance with this agreement. ARTICLE II. AUTHORITY This Civil Penalty Reclamation Cooperative Agreement is entered into pursuant to PL 100-446.
