Permit Revision #.1 <br />Mr, Bill Bear, Sr. <br />Somerset Mining Company <br />Dear Mr. Bear: <br />Several days ago we spoke with both you and Mr. Jim Stover of Somerset Mining <br />Company concerning work to be done for the railroad on their tracks and <br />railroad bed immediately adjacent to your proposed Sanborn Creek Mine. <br />We understand that the railroad plans to move the railroad bed and tracY,s to <br />the. south in the area of S1/2 SW 1/4 of Section 9, T13S, R90W. This work will <br />all be done within the railroad right-of-way, will be done under agreement <br />with the railroad, and will not affect any area within the current Somerset <br />permit. Due to these circumstances we do not believe that there is any impact <br />to either the approved permit or the proposed revision, and that the Division <br />has no jurisdiction over the conrJuct of the moving activities.
