Miscellaneous Compliance - Rules 2.05.6( ), 4.02, 4.12, 4.19, 4.21, <br />~~~' <br />No problems were identified with respect to the requirements of these <br />sections during the review. Based on information provided in Volume I <br />of the application, the operation is in compliance with all the <br />requirements of the above section. <br />XXVI. 0 erations on Lands Subject to Limitations or Prohibitions - Rules <br />an <br />The proposed permit area is not within; <br />1. Three hundred feet of an occupied dweiling not subject to valid <br />existing rights. <br />This operation is in compliance with the requirements of this section <br />and Rule 2.07.6 (2 )(d ). <br />XXVII. Demonstration that Surface Coal Mining and Reclamation Operations can <br />Fc ~'caei ~iTiT ~rrmm~ eT7~nrT-_'6iTc ~rTTTi/ <br />Contingent upon the satisfactory resolution of stipulations presented <br />in the findings document, the following finding of compliance is valid. <br />The Division finds, pursuant to Rule 2.07.6(2 )(b ), based on information <br />in the application and from all available sources, that surface coal <br />mining and reclamation operations can be feasibly accomplished under <br />the Mining and Reclamation Plan contained in the application. The <br />operation is in compliance with the requirements of this section. <br />XXVIII.Compatibility with Anticipated Adjacent Operations - Rule 2.07.6 (2)(i) <br />Pursuant to Rule 2.07.6 (2)(i), the Division finds that Wyoming Fuel <br />Compar{y operations will not be inconsistent with other operations <br />anticipated to be conducted in the areas adjacent to the permit area. <br />The operation is in compliance with the requirements of this section. <br />-38- <br />
