none of the special categories of mining will be conducted.

No problems were identified with respect to the requirements of these
sections during the review. Based on information provided in Volume I
of the application, the operation is in compliance with all the
requirements of the above section.

The proposed permit area is not within;
1. An area designated unsuitable for mining;
2. An area under study for designation as unsuitable for surface
coal mining;
3. Arty lands subject to other prohibitions or limitations; or
4. One-hundred feet of the outside right-of-way of any public road.
5. Three hundred feet of an occupied dweiling not subject to valid
existing rights.
This operation is in compliance with the requirements of this section
and Rule 2.07.6 (2 )(d ).
XXVII. Demonstration that Surface Coal Mining and Reclamation Operations can

Contingent upon the satisfactory resolution of stipulations presented
in the findings document, the following finding of compliance is valid.
The Division finds, pursuant to Rule 2.07.6(2 )(b ), based on information
in the application and from all available sources, that surface coal
mining and reclamation operations can be feasibly accomplished under
the Mining and Reclamation Plan contained in the application. The
operation is in compliance with the requirements of this section.
XXVIII.Compatibility with Anticipated Adjacent Operations - Rule 2.07.6 (2)(i)
Pursuant to Rule 2.07.6 (2)(i), the Division finds that Wyoming Fuel
Compar{y operations will not be inconsistent with other operations
anticipated to be conducted in the areas adjacent to the permit area.
The operation is in compliance with the requirements of this section.
