<br />Stipulation No. 35 <br />TOPSOIL SHALL BE STRIPPED FROM AREA 1 (WEST) PRIOR TO THE MOVEMENT OF <br />WASTE ACROSS THIS AREA. STRIPPING AND STOCKPILING OF ALL TOPSOIL AND <br />SUBSOIL FROM AREAS 1 (EAST), 2, AND 3 AS IDENTIFIED ON FIGURE 1., THE MAP <br />OF THE PROPOSED COAL PROCESSING WASTE PILE, IS REQUIRED PRIOR TO THE <br />PLACEMENT OF WASTE DURING THE SUBSEQUENT CONSTRUCTION OF THE WASTE PILE. <br />A MINIMUM 25' BUFFER ZONE, FROM WHICH TOPSOIL AND SUBSOIL HAVE BEEN <br />REMOVED, SHALL BE MAINTAINED BETWEEN THE COAL PROCESSING WASTE AND THE <br />UNDISTURBED PORTIONS OF THESE AREAS. PRIOR TO STOCKPILING SUBSOIL IN THE <br />LOCATION INDICATED ON FIGURE 1, THE TOPSOIL PRESENTLY EXISTING AT THAT <br />LOCATION SHALL BE TRANSFERRED TO ANOTHER AREA APPROVED BY THE DIVISION. <br />Stipulation No. 36 <br />WITHIN 60 DAYS FOLLOWING COMPLETION OF THE CONSTRUCTION OF THE DRAINAGE <br />DITCHES APPROVED AS PART OF TECHNICAL REVISION 04, WYOMING FUEL COMPANY <br />WILL PROVIDE THE D N ISION WITH APOST-CONSTRUCTION MAP OF THE LOCATION OF <br />THE DITCHES AND OF THEIR BEDROCK AND RIPRAPPED SECTIONS TOGETHER WITH <br />REPRESENTATIVE CROSS-SECTIONS, RIPRAP SIZING, AND AS-BUILT ENGINEERING <br />CERTIFICATIONS. CALCULATIONS ACCEPTABLE TO THE D N ISION SHALL ALSO BE <br />PROVIDED TO DEMONSTRATE THAT ALL SECTIONS OF THE CHANNELS CAN SAFELY PASS <br />THE RUNOFF FROM A 100 YEAR 24 HOUR PRECIPITATION EVENT. <br />These stipulations will be addressed upon completion of the expansion <br />construction. <br />Stipulation 23 of the original findings which discussed using less than 4 <br />feet of non-toxic cover no longer applies since the operator now plans to <br />use 4 feet of non-toxic cover. <br />Other information concerning the coal and non-coal processing waste can <br />be found in the application on pages 2.05-18 and 19 and in Exhibit 27 <br />(TR-04) and in the previous findings document. <br />Upon fulfilling the above stipulations the operation will be in <br />compliance with the requirements of this section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities - Rules <br />A description of the mine and support facilities can be found on page <br />2.05-7 and a list of the facilities on page 2.05-8, Table 16. <br />The coal handling structures are also discussed on page 2.05-18. <br />The operation is in compliance with the requirements of this section. <br />XX. Roads - Rules 2.05.3(3) and 4.03 <br />Information pertaining to the roads <br />pages 2.05-7 and 9 and Map 10.
