<br />are inadequate for reapplication over the entire disturbed area. <br />Taking this into account, WFC has submitted a plan whereby priority <br />areas will receive topsoil with the balance to be spot applied to roads <br />and other potential problem areas. A detailed account of this plan <br />along with an updated topsoil balance sheet can be found in Volume I, <br />pages 2.05-14 (a ), 2.05-23, 2.05-25 (a ), 2.05-29, and 2.05-30 (a ). The <br />updated balance sheet also takes pond 005 construction and the waste <br />pile expansion into account. <br />Upon submittal of the above information the operator is in compliance <br />with the requirements of this section. <br />XII. Vegetation - Rules 2.04.10, 2.05.4(2)(c) and 4.15 <br />Prior to and during this renewal four previous stipulations (18, 19, 20 <br />and 21) pertaining to vegetation and revegetation standards had been <br />satisfied. One major issue concerning vegetation was raised during the <br />renewal process. Prior to renewal, the application merely stated that <br />for reclamation purposes, the specific recommendation was included in <br />Exhibit 20, Re vegetation Procedure Study. This raised the question of <br />which of several specific recommendations for reclamation would <br />actually be followed. In determining the specific recommendation, the <br />operator discovered that two more cool season grass species should be <br />included in the seed mix and Table 21 was revised to reflect this. <br />Exhibit 13 was revised to provide the basis for which the <br />determinations were made. Text pages 2.05-23 through 2.05-26 were also <br />updated to facilitate this change. <br />Witty the above change the operation is now in compliance with the <br />requirements of this section. <br />XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />Information on fish and wildlife can be found on pages 2.04-31 and 32 <br />of the application. No change is required. Therefore,the operation is <br />in compliance with the requirements of this section. <br />XIV. Prime Farmland - Rules 2,04.12, 2.06.6 and 4.25 <br />The applicant has supplied documentation from the Soil Conservation <br />Service (USDA) stating that there are no prime farmlands in the <br />vicinity of the mine. Although a soil series (Tobin Silty C1 ay Loam) <br />was previously identified as prime farmland, the short growing season <br />of the region and poor capability class rating of the soil excludes it <br />from this classification. This information can be found in Volume I, <br />on page 2_.04-34 and in Exhibit 15. <br />Pursuant to 2.07.6(2)(k) and on the basis of documentation provided by <br />the applicant, the Division has determined that no prime farmlands <br />exist within the permit area. <br />-34- <br />
