<br />With satisfactory resolution of these stipulations and adherence to the <br />terms of the revision the operation will be in compliance with the <br />requirements of this section. <br />IX. Water Rights and Replacement - Rules 2.04,7(3), 2,05 <br />Information concerning water rights was submitted to and reviewed by the <br />State Engineers Office. Based on their review and memos and <br />correspondence contained in both Water Resource Division files and Mined <br />Land Reclamation Division files, the Division has determined that the <br />proposed operation is in compliance with the requirements of this section. <br />X. Climatological Information and Air Resources - Rules 2.04.8, 7_.05.4 (2)(h) <br />When an increase in water and gas occurred in early 1988 as a result of <br />development work in the Second Right workings, it became necessary to <br />vent off the methane via a degas wells. Minor revision 05 was approved <br />on April 25, 1988. This revision allowed for the installation of <br />degassing wells above the Second Right workings. Two stipulations, 39 <br />and 40, were attached to this approval. Stipulation 39 required <br />additional bonding for reclamation work associated with the new vent <br />holes. Stipulation 40 required that WFC secure the necessary permits for <br />venting the methane. As of this approval date, the Divison has not <br />received evidence that said permit was obtained. Therefore Stipulation <br />40 remains unsatisfied and is repeated here. <br />Stipulation 40 <br />PRIOR TO THE ACTUAL VENTING OF METHANE GAS FROM THE MINE WORKINGS TO THE <br />ATMOSPHERE BY MEANS OF PROPOSED VENTILATION HOLES E-1 and E-2, WFC WILL <br />SECURE THE NECESSARY PERMIT (OR A WRITTEN PERMIT EXEMPTION) FOR SUCH <br />VENTING FROM THE APPROPRIATE DIVISION OF THE COLORADO DEPARTMENT OF <br />HEALTH. <br />This stipulation also applies to Minor Revision 06 which was a field <br />approval for more vent holes. <br />When this stipulation is satisfied the operation will be in compliance <br />with the requirements of this section. <br />X I . Soi 1 s - P,ul es 2.04.9 , 2.05.3 (5 ) , 2.05.4 (2) (d) and 4.06 <br />Prior to renewal, all previous stipulations (15 and 17) pertaining to <br />soils had been satisfied with the exception of Stipulation No. 16. This <br />stipulation required that the operator submit a plan for topsoil <br />redistribution at the Golden Eagle Mine detailing areas to be topsoiled <br />and reapplication depths. During the renewal process the Division <br />requested that WFC satisfy this stipulation, Since most of the surface <br />facilities were constructed pre-law, little topsoil was stripped and <br />stockpiled during this process.
