<br />Various possible alluvial valley <br />permit and adjacent area prior to <br />of these AV Fs were determined to <br />Golden Eagle Mine operation. Data was supplied to demonstrate that drainage <br />from the pile would not cause material damage to the Picketwire <br />Valley AVF. <br />3. The proposed mining operations would preserve or restore the <br />essential hydrologic functions of the Picketwire Valley alluvial <br />valley floor. <br />Two other drainages in the permit and adjacent area, Apache and <br />Santistevan Canyons, were determined by the data available at the time to <br />contain alluvial valley floors. In the absence of adequate data being <br />supplied by the operator for the Division to make the required findings <br />of compliance with Rules 2.06.8 and 4.24, Stipulation 14 was imposed on <br />the approval of the original permit. Apache Canyon was subsequently <br />proven not to possess the necessary qualifications for an AVF. Such data <br />was never provided for Santistevan Canyon. As a result, Stipulation 14, <br />as regards Santistevan Canyon, remains a condition to the approval of the <br />permit. <br />Stipulation No. 14 <br />PRIOR TO SECONDARY OR RETREAT MINING UNDER APACHE CANYON OR SANTISTEVAN <br />CANYON, THE PERMITTEE MUST SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE FOR <br />THE D N ISION TO MAKE FINDINGS THAT SECONDARY OR RETREAT MINING UNDER <br />THESE CANYONS WILL: <br />1. NOT INTERRUPT, DISCONTINUE, OR PRECLUDE FARMING ON THE ALLW IAL <br />VALLEY FLOOR <br />2. NOT CAUSE MATERIAL DAMAGE TO THE QUANTITY OF GROUND WATER THAT <br />SUPPLIED THE ALLW IAL VALLEY FLOOR <br />PRESERVE THE ESSENTIAL HYDROLOGY FUNCTIONS OF THE ALLW IAL VALLEY <br />FLOOR <br />-31- <br />
