The proposed mining operations would not interrupt, discontinue, or
preclude farming on the Picketwire Valley alluvial valley floor.
2. The proposed mining operations would not cause material damage to
the quantity and quality of surface and ground water that supply
the Picketwire Valley alluvial valley floor. This finding was
conditioned that the refuse pile not be expanded until the effects
of it on the AVF be assessed. This condition was satisfied as part
of the approval of technical revision (TR-04) allowing expansion of
the refuse pile. Data was supplied to demonstrate that drainage
from the pile would not cause material damage to the Picketwire
Valley AVF.
3. The proposed mining operations would preserve or restore the
essential hydrologic functions of the Picketwire Valley alluvial
valley floor.
Two other drainages in the permit and adjacent area, Apache and
Santistevan Canyons, were determined by the data available at the time to
contain alluvial valley floors. In the absence of adequate data being
supplied by the operator for the Division to make the required findings
of compliance with Rules 2.06.8 and 4.24, Stipulation 14 was imposed on
the approval of the original permit. Apache Canyon was subsequently
proven not to possess the necessary qualifications for an AVF. Such data
was never provided for Santistevan Canyon. As a result, Stipulation 14,
as regards Santistevan Canyon, remains a condition to the approval of the
permit.
Stipulation No. 14
PRIOR TO SECONDARY OR RETREAT MINING UNDER APACHE CANYON OR SANTISTEVAN
CANYON, THE PERMITTEE MUST SUBMIT TO THE DIVISION SUFFICIENT EVIDENCE FOR
THE D N ISION TO MAKE FINDINGS THAT SECONDARY OR RETREAT MINING UNDER
THESE CANYONS WILL:
1.
