<br />Stipulation No. 11 was made to the approval of the original permit in <br />order to define the impacts of underground coal mining on both surface <br />and ground water. Annual inflow studies were required for the mine, and <br />the results were to be submitted Dy the first of August of the same year <br />in the Annual Hydrology Report. Stipulation No. 11 was satisfied during <br />the first permit term. The annual inflow study described on Pages <br />2,05,39 and 40 of the permit application is accepted as adequate for the <br />renewal term, <br />Information has not been supplied by the operator to completely describe <br />the stream/a1luv~aT systems of the permit area, specifically that of <br />Santistevan Canyon, as required by Stipulation 12 to the original <br />permit. Santistevan Canyon could be affected by subsidence attending <br />underlying secondary or retreat mining during the permit renewal term. <br />In order to assess potential impacts of such mining and to verify that <br />assessment, the applicant must adequately characterize and monitor all <br />streams in the permit and adjacent areas. In order to comply with Rule <br />2.04.7(2), 2.05,6(3)(b)(iii), 2.05.6(3)(b)(iv) and 4.05.13.(2), as <br />regards Santistevan Canyon, Stipulation 12 is retained. <br />Stipulation 12: <br />PRIOR 70 SECONDARY OR RETREAT MINING UNDER CIRUELA CANYON, APACHE CANYON, <br />AND SANTISTEVAN CANYON DRAINAGES, THE PERMITTEE MUST COLLECT DATA ON THE <br />QUANTITY OF WATER FLOWING IN THESE DRAINAGES. MONITORING MUST BE <br />SUFFICIENT TO DIFFERENTIATE SEASONAL FLOW VARIATIONS. <br />THE PERMITTEE MUST MONITOR THE QUALITY OF WATER FLOWING IN CIRUELA CANYON <br />QUARTERLY. MONITORING MUST BE DONE AT TWO SITES, ONE ABOVE THE MINE <br />WATER DISCHARGE POINT AND ONE BELOW TO COAL PROCESSING WASTE PILE. <br />THE PERMITTEE SHALL PROVIDE AN AMENDMENT OF THE PROBABLE HYDROLOGIC <br />CONSEQUENSES OF SECONDARY OR RETREAT MINING ON THE QUANTITY AND QUALITY <br />OF SURFACE WATER IN CIRUELA, APACHE, AND SANTISTEVAN CANYONS. <br />ALL MONITORING MUST CONTINUE UNTIL DISCONTINUATION IS APPROVED BY THE <br />DIVISION IN WRITING. <br />Stipulation No. 13 was made to the original permit approval in order to <br />verify the applicant's statement of probable hydrologic consequences, <br />identify adverse effects to the hydrologic system, and to ensure that <br />operations are conducted to minimize disturbances to the prevailing <br />hydrologic balance. Stipulation No. 13 was satisfied during the original <br />permit term. The form and content, properly updated, of the Annual <br />Report as presented in Exhibit 10 of the permit renewal application is <br />accepted as adequate for the renewal term. m. <br />VIII. Alluvial Valley Floors - Rules 2.06.8 and 4.24 <br />The original findings document contains extensive narrative which relates <br />the original determination of the existence of an Alluvial Valley Floor <br />(AVF) at the Golden Eagle Mine in the vicinity of the Purgatoire River. <br />The permit application also contains information concerning the <br />"grandfathering" of the surface facilities which are located on or near <br />the AVF. <br />-30- <br />
