date. The Company felt it was necessary to submit the two <br />mining plan proposals separately because of timing and <br />economics. BCC, Inc., recently initiated a geotechnical <br />study resulting from an MLRD stipulation to their mining <br />permit. Colorado MLRD's stipulation indicated that only <br />development mining would be allowed on the permit area until <br />a geotechnical study was completed on a large slide area <br />above the adjacent town of Somerset, to show the potential <br />impacts of subsidence on this slide. The study is partially <br />complete and only identifies the subsidence impacts for <br />development mining. Therefore, this proposed mining plan <br />only addresses development mining in the B seam. <br />No additional surface disturbance will result from this <br />action since it only involves the removal of a portion of <br />the lower coal seam (B) within the same Federal lease areas <br />as were previously approved for mining. With this action, <br />the Bear No. 3 mine mining plan area will contain a total of <br />551 acres in Federal leases D-052501 and C-42481. <br />Colorado Mined Land Reclamation Division (MLRD) reviewed the <br />PAP under the Colorado State program and the Colorado <br />cooperative agreement (30 CFR 906.30). MLRD approved the PAP <br />on April 13, 1989. <br />D. Previous Environmental Studies <br />Environmental studies prepared for the Bear No. 3 mine and <br />surrounding general area include: <br />- BLM's 1979 West-Central Colorado Coal environmental <br />impact statement. <br />- BLM's 1983 Uinta-Southwestern Utah coal region <br />environmental impact statement. <br />- OSMRE's environmental assessment for the 1982 Federal <br />mining plan approval for the Bear mine. <br />- OSMRE's environmental assessment for the 1985 Federal <br />mining plan approval for the Bear mine. <br />- Colorado MLRD's Decision and Findings of Compliance <br />Document prepared for the 1985 revision to State permit <br />C-033-81. <br />On April 24, 1989, OSMRE received Colorado MLRD's final <br />Decision for its approval of the PAP pursuant to the <br />Colorado State program and cooperative agreement. OSMRE has <br />reviewed Colorado MLRD's Decision and concurs with the <br />conclusions contained therein. <br />
