The applicant proposes that a fill <br />pad be placed in order to stabilize ground. Other alternatives, such as metal <br />plates or construction fabric should be considered as stabilizers, in this <br />instance. <br />The other access alternative is proposed for the crane to gain access from the <br />disturbed area west of the river. The applicant should indicate how the <br />existing sediment control system in this area would be preserved during the <br />construction period (i.e: will the collection ditch adjacent to the railroad <br />tracks be functional during the construction period). <br />As the applicant observes, the US Army Corp of Engineers has been <br />appropriately contacted in order to determine whether a 404 Permit is <br />necessary. The Division cannot grant approval for this technical revision <br />until we have received a written decision from that agency on this matter. If <br />it is determined that a permit will not be required, we will condition <br />approval of the technical revision to disallow any disturbance within the <br />channel between the dates of April 1 and June 30th. In addition, we will <br />require that photographic documentation of the proposed affected area's <br />condition be made by the applicant prior to, and following, the disturbance. <br />The temporary road and laydown areas appear acceptable as proposed. As the <br />applicant observes, a specific permit will be required from the Colorado <br />Department of Highways, because the proposed disturbance lies within the <br />highway right-of-way. The Divsion shall condition approval of the technical <br />revision upon receipt of the appropriate Colorado Highway Department Utilities <br />Permit. <br />Due to bonding provisions set for the removal of the overland belt upon <br />completion of mining, it is agreed that adjustment to the bond is not <br />necessary for the revision. <br />If you have any questions or would like to meet to discuss the application, <br />please contact me. <br />Si rel~ <br />Jo ph W.
