Terror Creek Mid-Term - 2 - February 12, 1986 <br />Part I. Revisions or Responses Required <br />Responses to the following concerns should be submitted in the form of a <br />technical revision by April 15, 1986, unless otherwise noted. <br />A. Legal, Financial and Compliance Information <br />The first page of the permit application and page 2.03.-5 should be <br />updated to indicate the address and phone number of the local <br />offices. <br />~An insurance certificate demonstrating current insurance coverage <br />should be submitted. This certificate should include a rider <br />requiring that the insuror notify the Division whenever any <br />substantive changes are made in the policy, including termination <br />or failure to renew. <br />Hydrologic Balance <br />1. No copies of NPDES reports have been submitted in the past. Please <br />address this omission. <br />C. Operations Plan <br />What is the current areal extent of the coal stockpiles and coal <br />pad on the bench. The facilities map, Map 5, should be updated to <br />reflect this area. <br />D. Reclamation Plan <br />1. The adequacy response dated, June 20, 1983, in the permit <br />application contains a commitment to submit production data from <br />the vegetation reference area starting in 1983. This information <br />does not appear to have been submitted. Please submit the required <br />information. Grass and legume species found in the comparison area <br />should be identified, and based on species composition of the <br />comparison area, a diversity or composition success standard and <br />measurement technique should be proposed. This is necessary to <br />insure that the bulk of the production from the reclaimed area is <br />of desirable species. <br />3. Unless justification for inclusion of the aggressive biennial <br />yellow sweetclover can be provided, we request that it be replaced <br />n with an adapted perennial legume consistent with the post-mine land <br />use. <br />(i4. A discussion in the soils information recommends fencing of <br />reclaimed areas to ensure success. Does Terror Creek Company plan <br />to fence the site during reclamation to preclude any grazing by <br />livestock or wildlife? <br />
