• Bear Coal Company has widened and modified the original access road to the
abandoned Edwards portals to access the Bear No. 3 portals. Bear Coal has
conducted stability studies to assess the stability of the Bear No. 3 portal
access road. Bear Coal conducts semi-annual stability monitoring of the access
road to access the stability of the road.
The portal access road meets the permanent program criteria with the approved
monitoring plan.
The operation is in compliance with this section.
II. Support Facilities -Rule 4.04
A. Information regarding the mine facilities of the Bear No. 3 Mine are contained in
Sections 2.05.2 and 2.05.3, Map 10, of the Bear No. 3 permit revision
application and in Exhibits 14, 19, and 24 of the Bear midterm responses.
Surface support facilities at the Bear No. 3 Mine include an office, two
warehouses, power substation, fuel transfer and storage area, conveyors,
stacking tube and a truck loadout. A sedimentation pond collects runoff from
the site to mitigate any adverse mining impacts to surface waters. Effluent
• from the pond must meet NPDES permit standards.
All surface facilitites of the Bear No. 3 Mine, except the office building, are to
be removed upon cessation of mining activities. Anchor Coal Company has
requested that the building be retained as part of the post-mining land use.
The Bear Coal operation is in compliance with the provisions of this section.
III. Hydrologic Balance -Rule 4.05
A. Water Quality Standards and Effluent Limitations
1. The applicant has demonstrated that sediment ponds and/or treatment
facilities will function properly to ensure that disturbed-area drainage will
meet the effluent limitations of 4.05.2 and the applicable State and Federal
water quality requirements for downstream receiving waters.
2. The Division proposes to grant a small area exemption from use of
sediment ponds due to the limited size of the area and due to the fact that
ponds and treatment facilities are not necessary for the drainage to meet
the effluent limitations of Rule 4.05.2 and applicable State and Federal
water quality standards for receiving streams, and also due to the fact that
no mixing of surface drainage from underground workings will occur. The
. small area to be exempted is located along the entrance road on the west
side of the entry bridge (4.05.2(3)). Technically, a small area exemption is
not needed for this area since the subject drainage is from a road.
t6
