<br />Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations an application for renewal of a valid existing permit for <br />reclamation only. The application was submitted by Enron Coal Company for the <br />Meeker Area Mines. This decision is based on a finding that the operations <br />will comply with all requirements of the Colorado State program as found in <br />the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq. and <br />the Regulations promulgated pursuant to the Act. If no request for a ~mal <br />hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. Upon <br />submittal of acceptable surety by the applicant, the permit will be issued. <br />The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />The permit application and the stipulations will become a binding part of the <br />permit upon approval. The stipulations for the Meeker Area Mines are as <br />follows: <br />Stipulation No. 7: <br />THE PERMITTEE MUST SUBMIT AN ANNUAL HYDROLOGIC REPORT. THIS REPORT SHALL <br />BE DUE JANUARY 1 OF EACH YEAR OF THIS PERMIT TERM, WITH THE FIRST REPORT <br />DUE ON JANUARY 1, 1985. THE ANNUAL HYDROLOGIC REPORT SHALL INCLUDE <br />INFORMATION AND ANALYSES OF DATA COLLECTED DURING THE PREVIOUS WATER YEAR <br />(E .G. OCTOBER 1, 1983 TO SEPTEMBER 30, 1484). 7HE FOLLOWING INFORMATION, <br />ANALYSES AND DESCRIPTIONS SHALL BE INCLUDED IN THE ANNUAL REPORTS. <br />A) SUMMARIES OF ALL SURFACE AND GROUND WATER QUALITY AND QUANTITY <br />MONITORING DATA; <br />B) HYDROGRAPHS OF SURFACE WATER FLOWS, MINE WATER DISCHARGES, AND <br />GROUND WATER LEVELS; <br />C) DESCRIPTION OF OBSERVED CHANGES IN GROUND AND SURFACE QUALITY; <br />D) DESCRIPTION OF OBSERVED CHANGES OR FLUCTUATIONS IN GROUND WATER <br />LEVEL, MINE WATER DISCHARGES, AND IN SURFACE WATER FLOWS; <br />E) DESCRIPTION OF OBSERVED MINING-RELATED IMPACTS TO GROUND AND SURFACE <br />WATERS; <br />Fi DESCRIPTION OF THOSE MEASURES UNDERTAKEN TO MINIMIZE GROUND AND <br />SURFACE WATER IMPACTS DURING THE YEAR; <br />G) PROJECTION OF POSSIBLE HYDROLOGIC IMPACTS OF MINING AND RECLAMATION <br />OPERATIONS IN THE UPCOMING YEAR; AND <br />H) DESCRIPTION OF MEASURES WHICH WILL BE UNDERTAKEN TO MINIMIZE THESE <br />PROJECTED HYDROLOGIC IMPACTS, SHOULD THEY OCCUR. <br />-2- <br />
