<br />Sec. 11. RELINQUISHMENT OF LICENSE--The licensee may relinquish this license, in whole <br />or in part, by filing in the Colorado State Office a written relinquishment. The <br />relinquishment shall be effective the date it is filed, subject to the continued <br />obligation of the licensee and his surety: (a) to comply with the terms and conditions <br />of the license, the exploration plan, and the regulations and (b) to provide for the <br />preservation of any permanent improvements on the licensed lands. <br />Sec. 12. REVOCATION OF LICENSE--This license may be revoked for noncompliance with the <br />terms and conditions of the license, the approved exploration plan, or the regulations <br />after the licensee has been notified of such violation and the licensee has failed to <br />correct the violation within the time specified in such notice. <br />Sec. 13. EQUAL OPPORTUNITY CLAUSE--This license is subject to the provisions of <br />Executive Order No. 11246 of September 24, 1965, as amended, which sets forth the <br />nondiscrimination clauses. A copy of this order may be obtained from the issuing office. <br />Sec. 14. STIPULATIONS--(a) For all areas which will be subject to surface disturbing <br />activities, a Class III cultural resources survey shall be conducted in accordance with <br />Sec. 6(a) of this license. If cultural resources are discovered during exploration <br />operations, the licensee shall immediately notify the White River Area Manager in <br />addition to the requirements of Sec. 6(b) of this license. <br />(b) If any fossils are discovered during exploration activities (construction of <br />access roads, drill sites, or other excavations, etc.), the operator shall immediately <br />cease operations and shall notify the authorized officer for a determination of the <br />significance of the discovery as specified in Sec. 6(b) of this license. <br />(c) Prior to any surface disturbance, the licensee shall schedule with the District <br />Manager and the Area Manager a joint field inspection. The joint field inspection shall <br />include BLM personnel, exploration company representatives, dirt contractor, and drill <br />operator. The inspection shall determine whether additional site-specific mitigating <br />measures are required to minimize environmental damage. If required, site-specific <br />stipulations shall be incorporated into the approved exploration plan. <br />(d) The licensee shall notify the District Manager and the Area Manager 48 hours (2 <br />regular working days) prior to the time initial surface disturbance commences on the <br />license. <br />(e) Dug way access shall be constructed on a maximum of 15X grade. Access trails <br />shall be back bladed with a cat to remove brush. Drainage crossings shall be swathed to <br />make low water crossings, and no drainages shall be plugged. <br />(f) The licensee shall strip from all drill sites and stockpile for later use in <br />revegetation at least eight inches of topsoil for reclamation purposes. <br />(g) Water shall not be removed from wells, springs, reservoirs, or any other water <br />source without approval from the legal owner. <br />(h) The licensee shall protect from contamination all water sources (including <br />streams, stockponds, springs and groundwater) by containment of drilling fluids in <br />on-site mud pits. If any drill holes produce more water than can be contained by the <br />pits, or if drilling fluids escape for any other reason, the licensee shall notify <br />promptly both the District Manager and the Area Manager. <br />(i) All pits constructed shall be adequately covered or fenced to eliminate hazards <br />to livestock and wildlife. Mud pit size shall be approximately 4'x15'x15' or as <br />otherwise approved by the Area Manager. Pits shall be constructed in cut bank and not <br />fill material. Pits shall be pumped out with the fluid disposed of at an approved <br />disposal area, or they shall be allowed to dry before being back filled and reclaimed. <br />(j) The Area Manager shall be notified 48 hours prior to reclamation of any <br />disturbed area. <br />
