<br />_p- <br />PROPOSED DECISION <br />CF&I STEEL CORPORATION <br />ALLEN MINE <br />~~ <br />The Colorado Mined Land Reclamation Division proposes to approve, in part, <br />with stipulations, an application for a permit to conduct coal mining <br />operations submitted by CF&I Steel Corporation for the Allen Mine. <br />The Division is proposing to approve, with stipulations, surface activities <br />and development mining operations only. Prior to approval of secondary or <br />retreat mining, the permittee will have to resolve informational deficiencies <br />and secure Division approval through the revision process. <br />The decision to partially approve the application is a result of the <br />Division's inability to approve all parts of the application because of <br />insufficient information. <br />The approval decision is based on a finding that the proposed operations to oe <br />approved will comply with all requirements of the Colorado Surface Coal Mining <br />Reclamation Act, C.R.S. 1973, as amended, 34-33-101 et seq. and the <br />regulations promulgated pursuant to the Act. <br />The permit application and the stipulations will become a binding part of the <br />permit upon approval. The stipulations for the Allen Mine are as follows: <br />Stipulation No. 1: <br />THE PERMITTEE MUST DEVELOP AND SUBMIT A SURFACE WATER• BUDGET THAT <br />ADDRESSES THE AMOUNT OF WATER REMOVED FROM THE MIDDLE FORK OF THE <br />PURGATOIRE RIVER OR WELLS, THE AMOUNT OF WATER THAT IS CONSUMPTIVELY <br />USED DURING MINING AND RELATED ACTIVITIES, ANO THE AMOUNT OF WATER THAT <br />IS DISCHARGED TO THE RIVER. THIS INFORMATION MUST BE SUBMITTED WITHIN <br />30 DAYS OF PERMIT ISSUANCE. <br />Stipulation No. 2: <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE SHALL ERECT STREAM <br />BUFFER ZONE SIGNS ON ALL UNDISTURBED AREAS BORDERING THE MIDDLE FORK OF <br />THE PURGATOIRE RIVER WITHIN AND DIRECTLY ADJACENT TO THE PERMITTED <br />DISTURBED AREA. THESE SIGNS MUST BE ERECTED AT THE EDGE OF THE <br />DISTURBED/UNDISTURBED AREA OR 100 FEET FROM THE EDGE OF THE STREAM, <br />WHICHEVER IS LESS. <br />Stipulation No. 3: <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT A STATEMENT <br />CERTIFIED BY A REGISTERED PROFESSIONAL ENGINEER THAT THE FOUR SEDIMENT <br />PONDS HAVE BEEN CONSTRUCTED AS DESIGNED. <br />
