The operator re-opened the file with the State Engineer's Office in January, and notified the <br />Division of the fact in eazly February 1994. Originally the operator pursued the first option but <br />decided on the second, aclosed-loop system with the submittal of Technical Revision No.19, <br />received June 16, 1994. <br />STIPULATION NO. 21 <br />THE OPERATOR WILL PROVIDE BY DECEMBER 31, 1993 AN EXPLANATION FOR <br />THE DATA INDICATING 27-29 DEGREES FOR AN ANGLE OF DRAW FOUND IN THE <br />1991 MAY-OCTOBER SUBSIDENCE REPORT, AND AS PART OF THE EXPLANATION, <br />PROVIDE TO THE DIVISION BY DECEMBER 31, 1993, APPROPRIATE <br />DOCUMENTATION ACCOMPANIED WITH AN EXPLANATION OF THE ERROR BY <br />THE SURVEYOR THAT THE DATA IS THE RESULT OF SURVEY ERROR AND NOT <br />MEASURED SUBSIDENCE. <br />Status -Terminated <br />The Division received a request for an extension to respond to this stipulation in a letter dated <br />December 29, 1993. The Division granted the request, extending the date to January 21, 1994. <br />A faxed response from TerraMatrix was received on January 17, 1994 which agreed with the <br />Division's more conservative angle of draw of 27 to 29 degrees. Technical Revision No.19 was <br />received on June 16, 1994 to address the boundary changes that the extended angle of draw <br />would incur. <br />STIPULATION N0.22 <br />THE OPERATOR WILL SUBMIT TO THE DIVISION BY JANUARY 31, 1994, UPDATES <br />TO ALL POND AS-BUILTS THAT INCLUDE ALL RECENT IMPROVEMENTS ON PONDS <br />1, 2, 3, 4, 5 AND LOADOUT PONDS L-1 AND L-2. <br />Status - Terminated <br />The updated pond as-builts were received and approved on January 31, 1994 via a fax copy. The <br />certified maps were received by the Division on February 2, 1994. <br />STIPULATION N0.23 <br />THE OPERATOR AND THE DIVISION WII,L RESOLVE OUTSTANDING BOND ISSUES <br />FROM THE MIDTERM REVIEW DURING THE PERMIT RENEWAL PERIOD, JANUARY <br />THROUGH MAY 1994. THE ISSUES THAT WILL BE RESOLVED ARE THE <br />FOLLOWING: REF,VALUATION OF THE BOND ESTIMATE SUBMITTED BY THE <br />OPERATOR AND UNTIL RESOLUTION, THAT THE CURRENT BOND AMOUNT OF <br />$849,410.00 WILL REMAIN IN PLACE, AND, SECONDLY, THAT THE FINAL <br />Southfield Mine Permit Renewal 04 10 September 10, 2004 <br />
