STIPULATION NO. 16 <br />WITHIN 30 DAYS OF APPROVAL OF PERMIT REVISION NO. 1, THE APPLICANT <br />SHALL SUBMIT TO THE DNISION THE FOLLOWING DEMONSTRATIONS FOR THE <br />SMALL AREA EXEMPTIONS WITHIN THE PERMIT AREA: 1) A DEMONSTRATION <br />THAT SEDIMENT PONDS OF TREATMENT FACILITIES ARE NOT NECESSARY FOR <br />DRAINAGE FROM THE AREA TO MEET EFFLUENT LIMITATIONS, AND 2) A <br />DEMONSTRATION THAT THE AREA IS SMALL AND THAT THERE IS NO MIXTURE <br />OF SURFACE DRAINAGE WITH MINE WATER DISCHARGE. <br />Status -Terminated <br />EFCI submitted Technical Revision 10 on July 1, 1991. The revision was approved September <br />6, 1991 and the stipulation was terminated. <br />STIPULATION NO. 17 <br />WITHIN 120 DAYS OF PERMIT REVISION APPROVAL, THE APPLICANT SHALL <br />SUBMIT DESIGNS FOR THE MAGPIE CREEK CHANNEL IN COMPLIANCE WITH THE <br />REQUIREMENTS OF RULE 4.05.4. THE DESIGNS SHALL INCLUDE PLAN VIEWS, <br />LONGITUDINAL PROFILE, CROSS-SECTIONS AND CHANNEL PROTECTION DETAILS <br />IN ORDER TO MEET THE REQUIREMENTS OF RULE 4.05.4(4). <br />Status - Terminated <br />In a letter dated August 22, 1991, the operator, EFCI, requested that the deadline for this <br />stipulation be tied to the approval, denial, or withdrawal of Technical Revision No.9. The <br />Division agreed and requested that EFCI submit designs within thirty days following a decision <br />on Technical Revision No.9 (TR09). TR04 was of&cially withdrawn on October 16, 1992. In <br />the Division's Mid-term Review dated November 1992, adequacy question No.14 requested a <br />response to this stipulation. The requested designs, plan views, longitudinal profile, cross- <br />sections and channel protection details were included in Technical Revision No.15, the response <br />to the Mid-term review. TR15 was approved on December 1, 1993. <br />STIPULATION NO. 18 <br />THE APPLICANT WILL SUBMIT TO THE DNISION AN ANNUAL REPORT OF <br />INFLOWS, DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS <br />REPORT IS TO INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND <br />QUANTITY OF INFLOW; A TABLE KEYED TO THE MINE MAP WHICH SHALL <br />CONTAIN THE SOURCE (LE. FAULT, FRACTURES, ETC.), QUANTITY, DURATION <br />AND QUALITY (LE. pH, ELECTROCONDUCTNITY AND TEMPERATURE OF ALL <br />INFLOWS; A TABLE CONTAINING RECORDS OF WATER DISCHARGED FROM THE <br />MINE, CONSUMED IN THE MINE AND IMPORTED FOR USE WITHIN THE MINE; AND <br />A DISCUSSION OF WATER BALANCE WITHIN THE MINE.
