• Memorandum To: From: Subject:. r~ ~J Unite~tates Department of the~nterior OFFICE OF SURFACE MINING Reclamation and Enfomment WASHINGTON, D.O. 20240 DEC 2 0 19~ Assistant Secretary for Energy and Miners Director, Office of Surface Minin Recommendation for Salt Creek M ing Company's Munger Canyon Mine Plan, Garfield County, Colorado (Federal Lease C-0125515, C-0125516) Pursuant to 30 CFR 741.12(d), I am advising you that the Office of Surface Mining (OSM) is prepared to approve a permit for the Munger Canyon Miae. My decision to approve Salt Creek Mining Company's application for a permit under the Federal Lands Program is based upon the applicant's complete permit application with the attached stipulations, publlc participation, and the review and processing of the application by OSM sad the Colorado Miae Land Reclamation Division as required by 30 CFR Chapter VII, Subchapter D and the approved Colorado State Program and compliance with the National Environmental Policy Act. I adopt the Administrator's recommended decision, which includes the findings required by 30 CFR 741.17. Accordingly, I am prepared to issue the attached permit if your decision on the mining and reclamation plan is favorable. The plan was submitted on December 12, 1980, with supplements submitted June 17, 1981, comprising 1-5 volumes and ownership tranfer information submitted November 8, 1982, which are summarized herein. Issuance of the permit, when validated by acceptance of the stipulations by the applicant, together with this memorandum, the filing of the performance bond and the contents of the attached recommendation package, will constitute my final decision under 30 CFR 741.21(a)(5). Under 30 CFR 787.11, my final decision is appealable to the Office of Hearings and Appeals.
