The U.S. Fish and Wildlife Service was consulted <br />regarding threatened and endangered species and provided a concurrence letter <br />•with stipulations in their letter received August 2, 1982. Both BLM and U.S. <br />Fish and Wildlife service have suggested stipulations on wildlife and <br />raptors. These suggested stipulations were consolidated and incorporated into <br />the decision document, (see page 30-32 of TA). The State Historic <br />Preservation Officer concurred with OSM's proposed compliance with 36 CFR Part <br />80 on August 14, and August 25, 1981. A copy of each letter of concurrence in <br />our files is enclosed. <br />The TEA, other documents prepared by CMLRD, the company's application, and <br />correspondence developed during the completeness review and technical and <br />environmental analysis are part of the mining and reclamation plan file. A <br />State Notice of Proposed Decision has been published in the Daily Sentinel and <br />is enclosed. In the Dail~Senti~nel Public Notice of a complete mine plan that <br />the company filed and t e~Seni=ineT-published February 24, 1981, March 3, & 10, <br />1981 and March 17, 1981, the company mentioned their haulroad will come within <br />100 feet of the outside right of way of Colorado Highway 139. The applicant <br />proposed a haulage road that joined the highway but does not parallel the <br />highway. Since 30 CFR 761.12(d) allows this type of activity, no variance is <br />necessary. In the above notice, the company listed the legal description for <br />the life of the mine area. CMLRD and OSM are permitting only 775.6 acres of <br />the listed legal description. This area is shown on the map found in the <br />Location Map Section of this decision document and in attachment 1 c~ the <br />permit. This mine, and the significant effects of the proposed mining and <br />• reclamation operations, have been addressed in the Department's Environmental <br />Impact Statement entitled West-Central Colorado Coal Environmental Statement, <br />issued in February 1979. As attested to in these documents, I have determined <br />that this action will not have a significant impact on the human environment. <br />Based on this review, and as reflected in the attached recommendation package, <br />I recommend that you find that Salt Creek Mining Company's permit application <br />affirmatively demonstrates that the conditions outlined in the Findings <br />enclosed have been complied with and that you recommend approval for the <br />Munger Canyon mining and reclamation plan. <br />• <br />
