STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Red Creek Ranch } <br />7600 South I-25 ) BOARD ORDER <br />Pueblo, Colorado 81004 ) <br />TO: Red Creek Ranch and all athec persons engaged in or owning or controlling the following <br />operation: Majors Ranch Pit which is located in section 31, T 27 S, R 68 W of the 6th <br />P.M. in Huerfano County, Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Boazd by <br />C.R.S. 24-4-105, the Board hereby makes the following findings of fact: <br />The Mined Land Reclamation Boazd conducted a Formal Public Hearing on November <br />19, 1997 to consider the petition by Red Creek Ranch for a Declazatory Order. <br />2. On November 19, 1997, the Board determined that the excavation located on the Majors <br />Ranch, which is to be used for the purpose of obtaining gravel to be used in the <br />construction of development roads as described in the petition document, is not an <br />activity requiring a state reclamation permit. <br />
