1 <br />4.0 PIPELINE OPERATION <br />4.1 Pipeline Corridor Maintenance <br />American Soda will maintain the pipeline ROW as required by the stipulations <br />t in the BLM's Conditions of Approval for the Yankee Gulch Project. All existing <br />improvements effected by construction and maintenance of the pipeline will be <br />kept in a serviceable condition. <br />' Maintenance of the ROW will include but not be limited to soil stabilization, <br />reseeding, and control of noxious weeds throughout the operations phase of the <br />' Yankee Gulch Project, as necessary. Soil stabilization and reseeding will be <br />consistent with the practices described above and in the Pipeline Reclamation <br />Plan provided in Attachment 1. American Soda will control noxious weeds on <br />' disturbed areas within the ROW. American Soda will consult with the BLM <br />and/or local authorities for acceptable weed control methods. <br />' Any use of pesticides will comply with the applicable federal, state, and local law. <br />Pesticides and herbicides will be used only in accordance with their registered <br />' uses and within limitations imposed by the Secretary of the Interior. Prior to the <br />use of pesticides, American Soda will obtain written approval of a plan showing <br />the type and quantity of material to be used, pests to be controlled, method of <br />' application, location of storage and disposal of containers, and any other <br />information deemed necessary by the BLM. <br />' 4.2 Pipeline Spill Contingency <br />The pipelines will be monitored continuously for pressure and flow and will be <br />' inspected periodically during operations. if a pipeline leak is identified from <br />monitoring instrumentation, American Soda would immediately check the <br />metering equipment for proper operation. if the meters are operating properly, <br />' the pipeline route would be inspected, and the appropriate pipeline section <br />would be shut down. If a leak is reported from visual observation, it would be <br />confirmed, and the pipeline would be similarly shut down. The location of the <br />' leak would be identified, and appropriate repairs would be made. A remediation <br />plan would be developed in consultation with the BLM or other landowner <br />based on the size, location, and potential consequences of the leak. <br />Immediately upon documenting the existence of a leak, American Soda would <br />notify the appropriate county sheriff's office.
