Long <br />Division Director <br />RE: Fugitive Coal Dust, Bowie No. 1 Mine, Permit No. C-81-038, Bowie Resources <br />Limited <br />Dear Mr. Bear: <br />As we discussed during our telephone conversation of July 31, 1998, the Division of <br />Minerals and Geology (the Division) received a phone call from a concerned citizen who <br />lives near the Bowie No. 1 train loadout. The concemed party stated that there has been a <br />problem with coal dust from the train loadout, specifically from the coal stockpile which <br />is located near the truck dump, and with noise during the night time. The concemed party <br />did not wish [o file a formal, written complaint at this time. The citizen did express the <br />desire that the residents in the area near the loadout be kept informed by Bowie Resources <br />of those activities at the train loadout that could possibly impact them. The citizen <br />specifically mentioned the idea of having utilizing a call list whenever a train was going <br />to be loaded. <br />I explained to [his citizen that the Division did not have direct jurisdiction over the noise <br />problem. I also explained that, although the Division did not have direct jurisdiction over <br />the fugitive dust problem, we did have indirectjurisdiction and might be able to assist in <br />its resolution. Scott Miller of [he Colorado Department of Public Health and Environment <br />in Grand Junction, which does have direct jurisdiction in this matter, is receiving a copy <br />of this letter. <br />The issue of fugitive dust from the Bowie No. l train loadout has been a topic of <br />
