<br />Mr. David Shelton, Director <br />Attn: Dan Matthews <br />February 18, 1982 <br />Page 2 <br />All reclamation activities should be conducted by Bear Coal Compaitiy in <br />compliance with applicable regulations and to the satisfaction of the Colorado <br />Mined Land Reclamation Division. Atlantic Richfield asswnes no responsibility or <br />liability for reclamation or revegetation success, nor any responsibility for <br />maintenance of the reclaimed areas. <br />The Bear Coal Company permit application states in Section 4.1.2 that Atlantic <br />Richfield will disturb and thus be responsible for reclaration of Freshwater Pond <br />No. 2. Atlantic Richfield proposed in its MBcR Plan that the pond would be located <br />near the Bear Mine Office and Shop area. Atlantic Richfield anticipates that <br />construction of this pond is several years away and thus requests that this area also <br />be reclaimed by Dear Coal Company to a fish and wildlife habitat: if Atlantic <br />Richfield redisturbs this area for Freshwater Pond No. 2, we will, upon cessation of <br />our mining activities, reclaim the disturbed area in accordance with all applicable <br />rules and regulations, <br />Atlantic Richfield does, however, anticipate the immediate need to use an area <br />adjacent to Bear's present coal stockpile area located at their loadout facility as a <br />temporary coal stockpile area. The area to be used by Atlantic Richfield is located <br />approximately 238 feet east of the Bear Mine Tipple Building, between Bear <br />Railroad Track No. 4 and the right-of-way of proposed Highway 133. The total <br />area to be used by Atlantic Richfield for this temporary coal stockpile measures <br />approximately 75' x 181'. Atlantic Richfield will accept responsibility for <br />reclaiming the temporary stockpile area to be used by Atlantic Richfield. Bear <br />Coal Company should be responsible for reclamation of the entire remainder of the <br />coal loadout/stockpile area, in addition to those areas south of the river as <br />discussed above. <br />If you have any questions, please do not hesitate to contact me at 575-7501 or <br />Paige Beville at 575-7949. <br />Sincerely, <br /> <br />D.
