PH D. <br />December 28, 1982 <br />Colorado Mined Land Reclamation Division <br />423 Centennial Bldg, <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />Gentlemen: <br />This letter is to register an objection to the issuance <br />of permit #C-041-81 to Powderhorn Coal Company and also to <br />request a formal hearing before the board. <br />I am managing partner for Powder P9ountain Ranch. Our <br />land is currently being mined by Powderhorn and we will be <br />adversely effected by the proposed decision. <br />The specific reasons for our objections to the proposed <br />decision are as follows: <br />1. The Division erred in finding that Westex•n Associated Coal <br />Corp (Powderhorn) does not own any operation which is <br />currently in violation of the provisions of the Colorado <br />Surface Mining Control and Reclamation Act: <br />(a) In January 1982 said corporation extended their mining <br />operation under our land in Sections 1 and 2, T 11 S, <br />R 98 W. They totally ignored their responsibility under <br />Article 4.20.2 to notify us of their plans. Quite to <br />the contrary: we had been assured by Joe Slingo (GBX <br />mine superintendent) that the mine would not enter Sections <br />1 and 2. This puts them in violation regarding public <br />notices. <br />(b) Article 4.20.1 of the same act requires Powderhorn to <br />"Assure that underground mining activities shall be planned <br />and conducted so as to prevent subsidence from causing <br />~,A/ <br />
