I have delayed filing this objection because <br />Mr. Greenlee has continually assured me that a settlement would <br />be reached based on the appraisal made by Frank tdisley Jr. There <br />are two subsidence a.rea.s involved; one mined by GEX prior to <br />January 1982 and the other mined by Western after that date. <br />Nisley calculated that the damage due to subsidence by Western <br />was $78,683 - Mr. Greenl~ehas offered me only $30,689. Using <br />Mr. Nisley~s figures on the area mined by GEX the subsidence <br />damage was $35,007 - I was offered $8,034. <br />I still hope that Western Associated Coal Corp will honor its <br />agreement and I would appreciate your holding the enclosed formal <br />objection until just before the filing deadline.
