<br />b. An area under study for designation as unsuitable for surface coal <br />mining operations, <br />c. Any lands subject to prohibitions or limitation under Rule <br />2.07.6(2)(d)(iii), and <br />d. Not within 300 feet, measured horizontally, of any occupied dwelling. <br />Additionally, the Division finds that the operation will not adversely affect <br />any publicly-owned park or place listed on the National Register of Historic <br />Places. <br />The operation is in compliance with the requirements of this section. <br />XXVII. Demonstration that <br />can oe <br />rface Coal Minin and Reclamation Operations <br />pise - ue <br />Pursuant to Rule 2.07.6(2)(b} the Division finds, based on information in the <br />application and from all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished under the mining and <br />reclamation plan contained in the original permit and permit renewal <br />application. <br />XXYIII. Compatibility with Anticipated Adjacent Operations - Rul <br />., <br />The Ohio Creek Coal Mine No. 2 is the only mine in the vicinity of Gunnison, <br />Colorado. ,41 so, the mine is completely surrounded by land used for grazing <br />and wildlife habitat. <br />Pursuant to Rule 2.07.6(2)(1) the Division finds that the operation will not <br />be inconsistent with other operations anticipated to be performed in areas <br />adjacent to the proposed permit area. <br />XXIX. Reclamation Fees Required by 30 CFR, Chapter VII, Sub-chapter R - <br />Ru e o <br />Based on contact with of the Office of Surface Mining on March 24, 1987, the <br />operator has paid all appropriate reclamation fees. <br />The Division finds that the proposed operation is in compliance with the <br />requirements of 2.07.6(2)(0). <br />~ _ <br />/vjr <br />5464E <br />-18- <br />
