• <br />The Division has been concerned that the current permit boundaries showed that <br />the applicant would be mining off the present Federal lease boundary into a <br />Federal lease block outside the permit boundary. The mine plan as reviewed by <br />the Division for the upcoming five-year term included mining only in the lease <br />block contained within the present 80-acre permit area. The application <br />submitted for renewal of the current permit does not include approval for <br />mining within a 120-acre Tease modification recently granted. Mining as <br />currently proposed should terminate in the year 1993. Reclamation will <br />commence immediately upon completion of mining. <br />The proposed operation is in compliance with the requirements of this Section. <br />XYI. Explosives -Rule 2.05.3(6) and 4.08 <br />No surface blasting will occur at this operation. Therefore, these sections <br />are not applicable. <br />The proposed operation is in compliance with this section. <br />XVII. Backfilling and Grading - Rules 2.05.3(91, 2.05.4(2)(c), 4.09 and <br />The approved backfilling and grading plan included as Exhibit 5 shows <br />regrading the area to approximate original contour. The material used to <br />construct the two bench areas will be pushed into the cut slopes with a dozer <br />or pulled up using a backhoe. <br />There are no acid or toxic-forming materials produced at this mine. The <br />underground development waste generated is roof-fall material which is <br />presently disposed of underground. The operator included a plan for an <br />underground development waste pile which is to be used if underground disposal <br />is not possible. As presented in the original pernit application, the pile <br />will have 3:1 side slopes and be compacted to 90% of standard proctor in two <br />foot lifts. Piles of the size proposed are inherently stable at a static <br />safety slope factor of 1.5 or more. Therefore, as long as the pile does not <br />exceed 1,000 cubic yards, no stability analysis should be necessary. However, <br />since no dimensions were originaiTy presented, the Division feels that the <br />following stipulation is necessary to find the proposed operations in <br />compliance: <br />STIPULATION N0. 2 <br />IF THE PROPOSED UNDERGROUND DEVELOPMENT '~IASTE PILE EXCEEDS <br />THE APPLICANT MUST CONSULT WITH THE DI'/ISION ABOUT THE A00 <br />INFORMATION AND PLANS REQUIRED. THE INFORMATION AND PLANS <br />TO THE DIVISION FOR REVIEW AND APPROVAL PRIOR TO EXPANSION <br />DEVELOPMENT WASTE PILE. <br />With this stipulation, the operation is in compliance with <br />this section. <br />1,000 CUBIC YARDS, <br />ITIONAL ENGINEERING <br />SHALL BE SUBMITTED <br />OF THE UNDERGROUND <br />the requirements of <br />-15- <br />
