Box 25367, DFC <br />Denver, CO 80225-0367 <br />-- -- - - <br />RE• K-Order No. 7620997 -Modification Regaest (Task 61 <br />Dear Mr. Owens: <br />Trapper Mining Inc. (TMn has previously requested and been granted a modification to <br />K-order No. 7620997 to clean, rip and mine the block ofH-seam coal located adjacent to <br />the southeast comer of the land slide that occun•ed at Trapper on October 8, 2006 (Task 6, <br />Order Number 7620997-04). This task has been initiated and is progressing smoothly. <br />At this time, Trapper is requesting that the activities described as Task 6 in the <br />Modification Request letter dated December 21, 2006, be expanded to allow this work to <br />occur after dark in addition to during daylight hours as originally specified. TMI believes <br />this work can be conducted safely after dark based upon our ongoing experience with the <br />slide and the adjacent azeas. Trapper has determined that this work can be conducted <br />safely regazdless of the time of day and desires the operational scheduling flexibility that <br />will allow this task to be completed in the most efficient manner possible. <br />Extensive survey monitoring has taken place in the immediate vicinity of the coal block <br />subject to this request. The survey monitoring has shown that the block of coal is stable <br />eats-af menu <br />less than one tenth of foot on a cumulative basis since the slide occurred with the <br />majority of that motion having taken place shortly after the slide. In addition, the point <br />velocities and accelerations calwlated from the survey data are negligible and to date aze <br />not a cause for concern. Periodic monitoring in this area will continue. <br />The spoil buttress, earlier proposed as Task 3, was completed in mid-December and <br />remains stable and in place below this coal block. The road providing access to the area <br />is also complete. The buttress provides an additional measure of protection even though <br />the coal block itself is situated outside of the area initially involved in the slide. The <br />buttress was constructed primarily to stabilize the scarp face and prevent further <br />sloughage along the northwestern margin of the coal block immediately adjacent to the <br />slide scarp.
