Dept. of Natural Resources <br />RE: Application of Peabody Coal Company, <br />Seneca II - W Mine; Request for Denial <br />of Application and for Party Status <br />Dear Members of the Board: <br />We represent Craig Weaver, a ranch owner and operator <br />in the Yampa Valley, who is adversely affected by the application <br />of Peabody Coal Company in connection with its Seneca II mine. <br />We ask that the application be denied, at least until <br />such time as it is revised, to avoid injury to an absolute water <br />right for a point of diversion at the Matthew Spring. Under <br />Peabody's current plans, one of its haul roads will obliterate <br />the spring, Mr. Weaver's point of diversion, thereby rendering <br />ineffective his water right and upsetting the hydrologic balance <br />in the area. Moreover, the haul road will cause water quality <br />degradation, from run off of salts, oils, sediment, and other <br />pollutants, into the spring, thereby rendering the water unfit <br />for its beneficial uses. <br />The road should be eliminated or rerouted, and adequate <br />protective design and operational measures implemented, in order <br />to avoid altering the status quo of the water source. <br />A copy of Mr. Weaver's absolute water right for the <br />spring is attached, along with a map showing location of the <br />
