Consultation with the State Engineer's Office has suggested that the dewatering of <br />the Twin Pines No. 2 Mine requires a well permit. Stipulation 3 requires Twin Pines <br />to acquire all well permits required by applicable State Law. Additionally, the <br />regulations speak to the protection of the rights of present users of surface and <br />ground water (2.05.6(3)(a)(ii)). Please obtain a well permit for the dewatering <br />activity, or provide evidence from the State Engineer's Office that a well permit is <br />not necessary.
