1 . Please review the Identification of Interests section (2.03.4) and confirm that the
information is correct. Additionally, if there have been changes in the owners or
leaseholders of the surface or underground coal rights, that portion of the
application should be changed accordingly.
2. Update the compliance portion of the permit application, documenting a list of all
violations received in the last three years and their resolution (Rule 2.03.5(311.
3. A current Proof of Insurance should be submitted to be inserted into the permit
application per Rule 2.03.8, Permit Term Information.
4. Please update the following permits in Appendix C of the permit application in
compliance with Rule 2.03.10.
a. Please provide a copy of the 1993 Explosives Storage Permit
to effect compliance with Rule 4.08.1(11.
b. The new County Special Use Permit should be submitted.
c. Please submit two copies of the current NPDES permit.
Land Use -Rules 2.04.3. 2.05.5 and 4.16
5. Please revise Section 2.05.5 to affirmatively state the post-mining land use as one
or more specific use types, i.e., fish and wildlife habitat, rangeland, etc.
Geoloav -Rules 2.04.5 and 2.04.6
6. Figure 2.04.6-2 suggests that the Chandler syncline is doubly plunging; please
clarify if that is indeed the case.
Water Riohts and Replacement -Rules 2.04.7(31, 2.05.6(31(iil, 2.07.6(2)lcl and 4.05.15
7. Consultation with the State Engineer's Office has suggested that the dewatering of
the Twin Pines No. 2 Mine requires a well permit. Stipulation 3 requires Twin Pines
to acquire all well permits required by applicable State Law. Additionally, the
regulations speak to the protection of the rights of present users of surface and
ground water (2.05.6(3)(a)(ii)). Please obtain a well permit for the dewatering
activity, or provide evidence from the State Engineer's Office that a well permit is
not necessary. We have enclosed an application for your use.
Hvdrolooic Balance -Rules 2.04.5. 2.04.7, 2.05.3, 2.05.6131 and 4.05
8. Please incorporate the hydrologic monitoring plan into the permit application to
allow the elimination of Stipulations 1 and 2 (Rules 2.05.6(31 and 4.05.13).
