subsidence monitoring reports. This proposed report format shall be submitted for Division <br />review within six months following issuance of the permit. Further, the permittee shall have <br />obtained approval of the subsidence report format prior to any mining within the coal seam. <br />Complied with 2/12/1986. <br />Stipulation #12 <br />NCEC will commit to providing information regarding Road 335 prior to any construction on <br />this roadway. <br />Complied With. <br />Stipulation #13 <br />The reclamation plan for the mine shall be revised to include downsizing of the current access <br />and temporary haul road from its present 40-foot width to a maximum width of 20 feet. <br />Reclamation of the remainder of this road shall be conducted according to the applicable <br />requirements of Rule 4.03.1(7). <br />Complied with. <br />Stipulation #14 <br />The applicant will reclaim all light use exploration roads except those specifically requested for <br />retention by the land owners. The retained roads, however, will have the surface, cuts and fills <br />re-seeded by the approved seed mixes to control erosion. <br />Complied with. <br />Stipulation #15 <br />The reclamation plan for the mine shall be revised to include regrading of the portal areas, <br />including related working pads and access roads, to a condition that approximates the original <br />site topography as indicated by the background contours on the NCEC preliminary mining <br />grading plan map - Schmueser & Associates revised 4/10!88. Topsoil distribution and <br />revegetation of the regarded portal areas will be consistent with that approved for the remainder <br />of the site. <br />Complied with. <br />Stipulatiou #16 <br />In the event that New Castle Energy Corporation's land use permits aze invalidated, NCEC shall <br />complete reclamation of the site within six months of the date of invalidation unless the Division <br />makes a written finding to extend the period of temporary cessation. The Division's finding shall <br />be based upon information submitted by NCEC to the Division demonstrating that good cause <br />exists to allow for an extended period of temporary cessation. <br />Tenninated 1/14/1997. <br />Stipulation #17 <br />Following Division inspection of the azea of well OW-41, the applicant shall within 60 days <br />7 June 1, 2006 <br />
