retention was submitted by the landowner [Rules 4.03.1(1)(f)(ii)and 4.03.2(1)(gxii)]. No portion of <br />the road is located in the channel of any stream [Rules 4.03.1(2)(6) and 4.03.2(2)(6)]. There is no <br />ford of an ephemeral or intermittent stream [Rules 4.03.1(2)(c) and 4.03.2(2)(c)].There aze no <br />alternative specifications for cut slopes aze approved by the Division [Rule 4.03.1(3)(d)(i)].There aze <br />no alternative specifications for embankment slopes approved by the Division [Rule <br />4.03.1(3)(e)(ix)]. There is no alteration or relocation of a natural channel drainageway [Rule <br />4.03.1(4)(a)(i)]. There aze no alternative specifications for culvert and bridge sizing approved by the <br />Division [Rule 4.03.1(4)(e)]. There is no specification of a lesser road grade approved by the <br />Division [Rule 4.03.2(3}(a)]. The Division approved retention ofthe one remaining road reclassified <br />as a light-use road (Rule 4.03.3(7). <br />II. Support Facilities -Rule 4.04 <br />The only support facilities constructed during the initial phase of the mine operation, other than <br />sedimentation control structures, were a powder magazine, a water tower, a pump house, a water <br />line, and roads. All were constructed in accordance with Rule 4.04. All, except for the <br />sedimentation control structures and permanent roads, were removed at the time of initial <br />reclamation. The permit is in cessation and reclamation. No new support facilities aze proposed <br />during the ensuing term of the permit. No past or existing support facilities incurred damage, <br />destruction, disruption of oil, gas, or water wells or pipelines, coal slurry pipelines, railroads, or <br />utility lines (none passed over, under, or through the permit area). Therefore, no written approval <br />from the owner of such facilities were received by the Division, and no approvals by the Division <br />were granted [4.04(6)]. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />Runoff from the majority of the disturbed azeas passes through a sediment pond prior to leaving the <br />permit area. The Division granted small azea exemptions from the use of sediment ponds. The <br />exemptions are based on the limited size of the azeas and the operator's demonstration (PAP Exhibit <br />4.7-3) that ponds and treatment facilities aze not necessary for the drainage to meet the effluent <br />limitations of Rule 4.05.2 and applicable State and Federal water quality standards for receiving <br />streams. There is no mixing of surface drainage with a dischazge from underground workings [Rule <br />4.05.2(3)(b)(i)]. Small Area Exemption No. 1, about 1/2 an acre, is located directly east of the <br />sediment pond. Small Area Exemption No. 2, about 4 acres, is located to the west of the sediment <br />pond, and adjacent to County Road 335. Runoff through these azeas is filtered prior to dischazge off- <br />site. See Map 4.7-1 of the permit for locations of the small azea exemptions. [Rule 4.05.2(3)(a)]. A <br />study has been incorporated into the PAP that indicates reclamation activities have progressed to the <br />extent that sedimentation control measures aze no longer required at the site. <br />B. Hydrologic Monitoring Program <br />Prior to reclamation of the site, groundwater was monitored in seven colluvial wells. At the time of <br />site reclamation, the Division found that groundwater monitoring was no longer necessary. This <br />finding was based on the facts that the mine never produced coal, the portal entries did not encounter <br />groundwater, and monitoring from 1984 to 1994 indicated the limited development work prior to <br />17 June 1, 2006 <br />
