he Act [2.07.6(2)(h)]. <br />9. The Division finds that surface coal mining and reclamation operations to be performed under this <br />permit will not be inconsistent with other such operations anticipated to be performed in areas <br />adjacent to the permit azea [2.07.6(2)(1)]. <br />10. The Division estimates the reclamation liability for mining operations at this time for this permit <br />term to be $35,666. The Division currently holds a bond associated with this permit, Certificate of <br />Deposit Number 133666870, issued by Wells Fargo Bank, in the amount of $43,200 [2.07.6(2)(j)]. <br />11. The Division has made a negative determination for the presence ofprime farmland within the <br />permit azea. The decision was based on a letter from the Soil Conservation Service that demonstrates <br />that no prime farmland mapping units are found within the permit azea [2.07.6(2)(k)]. <br />12. Based on information provided in the application, the Division has determined that three alluvial <br />valley floors exist within the permit or adjacent area. The alluvial valley floors aze known as the <br />Colorado River, Alkali Creek, and South Canyon Creek. However, only the Colorado River alluvial <br />valley floor would have been potentially affected by Coal Ridge No. l Mine operations [2.07.6(2)(k) <br />and 2.06.8(3)(c)]. For additional specific findings concerning this alluvial valley floor please see <br />Section B, Part IX of this document. <br />13. The Division approved the post-mining land (agricultural) uses of grazing and cropland, and <br />wildlife habitat. These land use meets the requirements of Rule 4.16 for the permit area <br />[2.07.6(2)(1)]. <br />14. The Division finds the specific approvals identified in Section B below have been granted or are <br />proposed [Section B (2.07.6(2)(m)]. <br />15. The Division finds that the activities proposed by the applicant would not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse modification of <br />their critical habitats [2.07.6(2)(n)]. <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of this <br />time, CB Minerals Company, the operator, is current in the payment of reclamation fees required <br />by 30 CFR Chapter VII, subchapter R [2.07.6(2)(0)]. <br />Section B -Rule 4 <br />I. Roads -Rule 4.03 <br />The initial portion of the existing road into the site was to be used as a haul road, and the upper <br />portion for access (PAP page 4-10). The only roads presently unreclaimed aze permanent roads (PAP <br />page 4-53). No new road construction is proposed during the ensuing term of the permit. <br />No alternative criteria and specifications were used during the design of this road as a haul road <br />[Rule 4.03.1(1)(e)]. The Division approved the retention of roads since they were compatible with, <br />and support [Rule 4.03.3(7)], the approved post-mining land use (agricultural), and a request for their <br />16 June 1, 2006 <br />
