<br />1 <br />;Applegate <br />Group, ~~~. <br />December 27, 2004 <br />Weld County Department of Planning Services <br />1550 North 17`h Avenue <br />Greeley, CO 80631 <br />RE: Addendum to Application for Sand and Gravel Mining Operation, USR-1350 <br />To Whom It May Concern: <br />Aggregate Industries-WCR, Inc. is submitting the following information and attached material as <br />an addendum to the pending application for a Mining Use by Special Review Permit application <br />(USR-1350). The application is for lands located in portions of Sections 25 and 36, Township 1 <br />North, Range 67 West, and a portion of Section 30, Township 1 North, Range 66 West, of the 6`h <br />P.M, all in Weld County Colorado. The operation will be known as Wattenberg Lakes. <br />In June 2001, a Weld County Use by Special Review permit application was submitted to the <br />Department of Planning Services for the Aggregate Industries' proposed Wattenberg Lakes <br />project. The application and related materials were considered complete and a hearing before the <br />Weld County Planning Commission was held October 16, 2001.. In response to Planning <br />Commission concems, Aggregate Industries requested that the hearing be continued. The <br />concerns were largely based upon referal comments the County had received from the U.S. Fish <br />and Wildlife Service (USFWS) and the U.S. Environmental Protection Agency (EPA) regarding <br />the Clean Water Act Section 404 permit application through the Army Corps of Engineers <br />(COE). Upon recommendation of Planning Staff, the Planning Commission voted unanimously <br />to continue the matter indefinitely to provide ample opportunity for the 404 permit related issues <br />to be resolved prior to the Planning Commission Hearing. <br />Aggregate Industries has diligently worked with the COE, USFWS, and the EPA since October <br />2001 to address their concerns. Through this process, the finally accepted extraction area has <br />been modified from the plan previously submitted with the pending USR application. However, <br />the modifications have not resulted in an expansion or enlazgement of the originally proposed <br />extraction area, but rather a reduction of disturbance to jurisdictional wetlands and acreage to be <br />mined.
