Findings of the <br />Colorado Mined Land Reclamation Division <br />fo r <br />Keenesburg Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07,6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division must <br />make specific written findings prior to issuance or substantial modification <br />of a permit. These findings are based on information made available to the <br />Division that demonstrates the applicant will be able to continue to operate <br />in compliance with Colorado Surface Coal Mining Reclamation Act and the <br />Regulations promulgated pursuant to the Act. This findings document is for a <br />permit revision to extend the permit area for the Keenesburg Mine which is <br />currently operated by Coors Energy Company. <br />This findings document is organized according to the major disciplines <br />reviewed during the permitting process. The written findings which must be <br />made by the Division are addressed under the appropriate discipline <br />sub-title. Additionally, any specific approvals required to be made by the <br />Division pursuant to Rule 2.07.6(2)(m), are discussed under the appropriate <br />discipline subtitle. <br />Once a permit revision is issued, the conditions must be fulfilled to keep the <br />permit valid, and stipulations must be satisfied in order to maintain <br />compliance with the statute, regulations and permit. Failure on the part of <br />the permittee to satisfy the conditions and stipulations of the permit would <br />result in the permittee being in violation and appropriate enforcement actions <br />would result. <br />I. Legal, Financial, and Compliance Information - Rules 2;03, <br />Information regarding legal, Financial, and Compliance Information is found on <br />pages 1 through 33 of the permit application. <br />The ok (Coors Energy Company) has provided copies of the documents of <br />conveyance granting to the applicant the right to extract coal by surface <br />mining methods, in areas where the private mineral estate is severed from the <br />private surface estate, as required under section 2.03.6(2). The Division has <br />reviewed these documents and finds the applicant in compliance with section <br />2.03,6(2} of the regulations. <br />-7- <br />
