• ~ On the basis of evidence submitted on pages 1 through 15 of the application, <br />the Division finds that Coors Energy Company does not own or control any <br />operations which are currently in violation of any law, rule, or regulation of <br />the United States, or any State Law, rule, or regulation, or any provision of <br />the Surface Mining Control and Reclamation Act or the Colorado Surface Coal <br />Mining Reclamation Act. <br />Coors Energy Company does not control and has not controlled mining operations <br />with a demonstrated pattern of willful violations of the Act of such nature, <br />duration, and with such resulting irreparable damage to the environment as to <br />indicate an intent not to comply with the provisions of the Act. This finding <br />was further verified by responses received from the Office of Surface Mining <br />and other states during the 510(c) review process conducted by the Division. <br />The proposed mining operation is in compliance with the requirements of tis <br />Section. <br />II. Land Use - Rules 2:04.3, 2.05.5 and 4.16. <br />Information regarding Land Use is found in on pages 34 through 37 of the <br />permit application. <br />The Division hereby approves the post-mining land use of the operation. It <br />was determined that rangeland meets the requirements of section 4.16. <br />The permittee is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2:04:4 and 2.05.6(4). <br />Information regarding Cultural and Historic Resources is found in on page 38 <br />and in Appendix E of the permit application. <br />The applicant submitted a report from Cultural Resource Consultants, Inc., to <br />ensure compliance with the State Antiquities Act of 1973, the State Register <br />of Historic Places Act of 1975 and the National Historic Preservation Act of <br />1966. The report consisted of a site-specific literature search supplemented <br />by on-site inspection by archaeologists. Based on this report, and on <br />contacts made with the State Historical Preservation Officer, the Division <br />finds that the mining operation will not adversely affect any publicly owned <br />park or place listed on the National Register of Historic Places. <br />The permittee is in compliance with the requirements of this section. <br />IY.
