• the construction of the new King II mine portal and facilities adjacent to the <br />existing King Coal mine for coal recovery by room and pillar operations in the <br />Menefee Coal Bed No.l seam on approximately 80 acres of Federal lease COC- <br />62920 within the area covered by Colorado State permit C-81-035, in; <br />Township 35 North, Range 12 West New Mexico P.M. <br />Section 35, N'/zSE'/a. <br />The life of the mining operations is expected to continue for an additional one (1) year <br />under Colorado Permit C-81-035 and this proposed new mining plan. <br />The average annual production rate and the maximum production rate would not change. <br />The approved State permit area would increase by 720 acres from its present 2,092 acres <br />to a new total of 2,812 acres. <br />Surface disturbance within the approved State permit area will increase from its present <br />11 acres to a new total of 31 acres. <br />This new mining plan will add 80 acres for recovery of Federal coal to the approved <br />mining plan area shown on the map included with this decision document. <br />• Approval of this new mining plan will authorize mining of an additiona1477,000 tons of <br />recoverable Federal coal. <br />Approximately 80 acres of Federal surface lands will be included in the mining plan area <br />as a result of this action. <br />The post mining ]and use within the permit and mining plan area will not change. <br />The CO-DMG did not place any Specie] Conditions on this permitting action. <br />National King Coat, LLC's new mining plan does not require any additional Special <br />Conditions to comply with Federal laws. <br />IV. Review Process <br />The CO-DMG reviewed the PAP under the Colorado State program, the Federal lands <br />program (30 CFR Chapter VII, Subchapter D), and the Colorado cooperative agreement <br />(30 CFR § 906.30). Pursuant to the Colorado State program and the cooperative <br />agreement, CO-DMG approved the permit revision on June 15, 2006. <br />The Office of Surface Mining Reclamation and Enforcement (OSM) has consulted with <br />• other Federal agencies for compliance with the requirements of applicable Federal laws. <br />Their comments and/or concurrences are included in this decision document. <br />
