<br />Established vegetation that supports the approved post mine land use and which meets the <br />approved success standard for vesetative cover. <br />3. Reclaimed the lands so they are not contributins suspended solids to streamflow or runoff <br />outside the permit area in excess of preminin~ levels or in excess of adjacent nonmined <br />areas. <br />4. Converted two ponds on the bond release block to permanent impoundments in compliance <br />wi[h the Resulations. <br />Based on the foregoing individual findings, the Division finds that HGCC has met all the <br />requirements for Phase II release of bond from the subject lands. <br />PHASE III RELEASE <br />HGCC requested Phase III release from the lands delineated on the Phase II/III Bond Release Map <br />(Drawing No. 1) in the bond release submittal package. The Division reviewed the bond release <br />application, the mine permit, and inspected the lands. Based on the review and inspection, the <br />Division finds that on the bond release lands, HGCC has: <br />1_) Applied for final bond release no less than 10 years after the last year of augmented <br />seeding, fertilizing, irrigation or other work. <br />2) Successfully completed all surface coal mining reclamation operations in accordance <br />with the approved reclamation plan. <br />3) Fully met all reclamation requirements of the Rules and the Act. <br />VII. PROPOSED DECISION <br />Based on the findings set forth above, the Division proposes to approve H-G Coal Company's <br />request for a Phase II and Phase III bond release for the Hayden Gulch Mine. This proposed decision <br />will release H-G Coal Company from liability for all reclamation work on the 357.3-acre bond <br />release block. H-G Coal Company will retain reclamation liability for approximately 6.8 acres <br />comprised of three shrub enclosures and a slump area. This proposed decision to release liability <br />for all reclamation work also applies to the 918.70 acres of undisturbed lands within the permit area. <br />The following table summarizes the history of changes in bond liability for the Hayden Gulch Mine. <br />Hayden Gulch Mine Page 15 May 25, 1999 <br />Phase II/III Bond Release <br />
