HAZARDOUS MATERIALS Any and all hazardous wastes, substances or materials including, but nct limited Lo asbestos, polychlorinated biphenyls (PCBs), mixed and radioactive wastes, shall at all times be and remain the responsibility of Client. Any arrangements which may be made by Remcor involving the handling, disposal, treatment or transport of any such hazardous materials shall be construed as being made sole- 1y and exclusively for Client's benefit and as its agent. Client shall have the responsibility for properly reportinq.the existence of hazardous materials to the appropriate federal, state oz local authorities. 6. All laboratc:y and field equipment that cannot be readily and ade- quately cleaned of its hazardous contaminants shall, at Remcor's option, become the property and responsibility of the Client. Disposal of such equipment shall be the responsibility of the Cli- ent. Alternate arrangements to ship such equip..-,,eni 8irectly to a licensed disposal ,facility may be made at the Client's request and expense. 7. CONFiDNTiALITY Remcor a;:ees to hcld as confidential and to not distribute to any third party any •doeuments including reports, studies, drawings. plans and speciFieations, prepared or furnished by fiemcor, its as- sociates, cors::ltants and subcontractors, or furnished to Remeoz by Client, pL:suant to this Agzeer~ent. Furthera~o:e, Remcor agrees to refrain :roc, any oral cor~aunication pith any third party with re- spect to its xork for the Client under this Agreement or with ze- spect to any doeur„ent produced in connection with the P.areement. This paragraph shall not prevent the dissemination, hohever, of any docur,,ent by Remcor to a third party or any oral eorYnunication be- tween Remcor and a third party (1) that ie ordered by a court oz govern,:,e-t agency, or (2) that is allowed by written permission of the C1ienL. Each party ails retain as confidential all information and data furnished to it bX •the other party which is related to the other party's technologies, formulae, procedures, processes, methods, trade secrets, ideas, improvements, inventions, and/or computer programs, which are designated in writing by such other party ae confidential in connection with this Aq:eer:ent, and shall not dis- elose such information to any thirfl party.
