"Roblin" site) located near the Cherry Farm site and adjacent to <br />the River .Road site in Tonawanda, New York. The Roblin Site was <br />formerly owned by the Debtor and sold in 1966. To date, <br />preliminary investigations have been performed by NYSDEC but no <br />final determination has been made by NYSDEC that the site ;poses a <br />significant threat. In a separate action, the EPA has ordered a <br />removal action under CERCLA for certain materials abandoned or <br />disposed at the site by Envirotek, a recycler which operated at <br />the site in the early 1980's. CF&I has not been notified by EPA <br />of any potential liability as to the removal action, nor has EPA <br />made a claim for any such liability in this proceeding. The <br />Debtor has, heretofore, been unable to determine the full extent <br />of its cleanup requirements at the River Road site or the extent <br />of its required participation in cleanup. The following entity <br />has filed claims against the Debtor with respect to the River <br />Road site: <br />a. The NYSDEC has filed two claims against the <br />Debtor with respect to the Roblin site: (1) a protective <br />priority/administrative claim in an undisclosed amount for post- <br />petition cleanup costs which claim is contingent upon its right <br />for post-petition cleanup costs from the Debtor being properly <br />considered a claim and, (2) a prepetition unsecured claim for <br />study cosi;s in the amount of $83,461.46. <br />10.
