Debtor for amounts incurred or to be incurred by Niagara Mohawk '
in the cleanup of the Cherry Farm Site -- the claim also asserts
administrative priority; (3) Riverside Service Corporation has
filed an administrative claim against the Debtor in the amount of
$10,000,000; and (4) General Motors Corporation has filed a claim
against the Debtor in an unspecified amount and of an unspecified
type.
8. In 1985,
the NYSDEC requested information related to an industrial
landfill site (the "River Road" site) located immediately
adjacent to the Cherry Farm site in Tonawanda, New York. The
River Road site was formerly owned by the Debtor and sold in
1966. The Company furnished the requested information and was
notified by the NYSDEC that the River Road site constituted a
significant threat to the environment. Further, the NYSDEC
advised that it had documented a release and/or threatened
release of "hazardous substances" as defined by CERCLA. To date,
preliminary investigations have been performed by NYSDEC which
has asked the PRPs to undertake a remedial investigation of the
River Road site. The Debtor has, heretofore, been unable to
determine the full extent of its cleanup requirements at the
River Road site or the extent of its required participation in
cleanup. The following entities have filed claims against the
Debtor with respect to the River Road site:
6
