in the possession of CF&I Steel in a form as to which reclamation
would be feasible; the remaining 1,172 had been consumed in the
normal course of CF&I Steel's business. By applying a dollar per
unit value to the consumed refractories, CF&I Steel calculated
that approximately $713.40 worth of refractories were consumed by
CF&I Steel before demand for reclamation was made on November 7,
1990. Accordingly, CF6I Steel subtracted that amount from the
total November 6 invoice amount and seeks court approval of only
$646.12 as a Valid Reclamation Claim.
Similar adjustments and calculations were made with respect
to all vendors whose goods were no longer in CF&I Steel's
possession on the date reclamation demand was made with respect
to such goods. The analysis underlying such adjustments and
calculations is set forth in Exhibit Al attached hereto. Exhibit
Al includes, with respect to each invoice of each vendor whose
claims are affected, an analysis of goods remaining in CF6I
Steel's possession on the date reclamation demand was made by
such vendors and the adjustment made to their claims with respect
to goods no longer in CF&I Steel's possession. Invoices listed
in Exhibit A but not analyzed in Exhibit Al is indicative that
all goods with respect to such invoice remained in CF&I Steel's
possession on the date of demand for reclamation.
An explanation of the column headings on Exhibit Al which
differ from the column headings on Exhibit A follows:
Num Pcs On Hand on D.O.C.: (Number of Pieces on Hand
on Date of Claim) Indicates the amount of goods on a
per unit basis received by CF6I with respect to any
particular invoice.
15
