4. Refractories West's reclamation demand on <br />November 7, 1990 was untimely with respect to goods recei~~ed <br />by CFSI Steel on October 16, 1990. <br />5. UCAR-Linde's reclamation demand on November 7, <br />1990 was untimely with respect to goods received by C1'&I <br />Steel. on September 14, 1990 through October 16, 1990. <br />E. <br />As ve:-ified in the affidavit of Ronald K. Craft, attached <br />hereto, thc: reclamation goods which give rise to the Valid <br />Reclamation Claims were in existence and in the possession of <br />CFSI Steel on the date demand was made with respect to the <br />reclamation of such goods. See Affidavit of Ronald K. Craft, <br />Exhibit H, q 9. Such goods had not been consumed, sold or <br />altered in the manufacturing process. CF&I Steel made this <br />determination by examining its inventory records and by <br />questioning the employees who use or consume the goods for which <br />demand for reclamation was made. <br />If reclamation goods were used in the manufacturing process <br />or otherwise consumed before a reclamation demand was made for <br />such goods, CF&I has subtracted the price of such consumed goods <br />from the invoice amount. For example, the vendor A.P. Green sold <br />CF&I Steel ~~oods (refractories) under invoice number P21251 <br />(dated November b, 1990) in the invoice amount of $1,359.52,. <br />This amount represented approximately 1729 refractories. On the <br />date A.P. Green made its demand for reclamation, however, only <br />557 refractories with respect to the November b invoice remained <br />14 <br />
