Lochhead <br />Eteculrve Dneclor <br />~siirhael B Long <br />Derision Direaur <br />The Division has reviewed the correspondence from Montgomery Watson Mining Group, which <br />addresses Stipulation Numbers 7 and 9 for the Yoast Mine Permit. We acknowledge that <br />pertinent data and information regarding probable hydrologic consequences (PHCs) and alluvial <br />valley floors (AVFs) near the Yoast bfine have been presented in the permit application package. <br />However, that information indicates that proposed mining operations may result in material <br />damage to the waters of Sage Creek. This possibility needs to be addressed further. <br />To adequately address Stipulation Numbers 7 and 9, additional information and/or clarification is <br />requested. Questions presented in our letter dated June 7, 1995 concerning PHC and AVF issues <br />have not been addressed by Seneca Coal Company. Please refer to question numbers 1-7 in the <br />attached letter from the Division dated June 7, 1995. SCC responses to these questions should <br />provide the Division with the information necessary to assess compliance with the referenced <br />stipulations. Because resolution of these issues may require considerable effort on the part of <br />SCC and the Division, we recommend scheduling a meeting to discuss the pending stipulations. <br />~"` Thank you for your cooperation.
