I have not <br />been able to locate any documentation stating otherwise. The <br />letter from the Las Animas County Health Department, dated January <br />17, 1995 is incorrect in classifying the mine as being in an <br />Industrial Zone, Las Animas County does not have such a zone <br />classification. <br />In my opinion, the independent sound testing that I did on the <br />blowers that Basin Resources, Inc. installed do overwhelmingly <br />exceed the noise level according to Colorado Revised Statutes 25- <br />12-103. maximum permissible noise levels for Rural Residential <br />Zones which is the zone of the mine location, However, this would <br />have to be enforced by the State or County Health Departments as <br />this falls within their ,iurisdiction and not the Las Animas County <br />Zoning Department. <br />I would suggest you write a letter to the Board of County <br />Commissioners requesting an investigation into the blowers to <br />determine if they are consistent with the Conditional Use Permit <br />granted in 1976 to Colorado Fuel & Iron Corporation- i have been <br />unable to locate any documentation in the original files that <br />mention any blowers to be installed for mining purposes. Before I <br />can take any action, I must have the Board of County Commissioners' <br />approval.
